A booking photo is made during the identification process after an arrest. It remains tied to that booking even after the person leaves the jail building. The image does not prove guilt, current custody, sentence completion, or final discharge. A person may have been released by court order, transferred to another custodian, placed in a supervised program, or later had the charge dismissed. Oregon does not treat every booking photo as freely available to any requester. ORS 133.870 generally bars a law-enforcement agency from releasing a booking photo except through listed circumstances. Local news may publish an agency-supplied image when reporting a public-safety event. A reporter may also use a file photograph that is not a booking image. Remove a Clatsop Booking Photo
ORS 133.875 addresses publish-for-pay booking-photo publications. It generally requires removal and destruction within 30 calendar days after a request and bars a charge above $50. When documentation shows acquittal or no prosecution, or that a conviction was set aside, vacated, or pardoned, the statute provides a seven-calendar-day, no-fee route.
